Term of notice is a legal term that refers to the notice period that you serve in an organization after intimating your intention to leave the organization. This term also covers the notice period that your employer has to give you after deciding to fire you from the organization. Every offer letter that you sign in before joining an organization would have clauses related to term of notice. It includes how many days you have to serve the company after applying your resignation and it also explains the circumstances under which the company can ask you to discontinue. Term of notice does not apply to the cases of termination.

Why is the term of notice important? Every organization depends upon its employees up to a very large extend and the same, employees depend on their pay check to carry on their day-to-day life. Therefore, it would be a big loss for the company, if one fine morning you refuse to continue your services. On the other side, it would be difficult for you, if suddenly one day, your employer asks you to discontinue your service.

How does the term of notice help? If you look at it from an employer’s point of view, they put in a lot of effort and invest some amount to train you and make you suitable to handle the given task. They would need time to find a replacement for you, train him/her and fill your chair.  Term of notice gives the employer time to find a suitable person to fill your position and relieve you from the services without disturbing the business.

Same applies to the employees. It’s mandatory that employers issue a term of notice after deciding to fire an employee.  This gives the employees time to find another job and continue earning.

Duration of the notice period The term of notice varies depending upon the company policies and laws in the respective countries. Sometimes, it also depends upon your designation in the organization. It’s harder to appoint a manager in an organization than a laborer. The new manger has to learn the business functions and suit them to manage the operations involved in the business. This takes longer time than a low-level employee fits into the firm. Therefore, in the majority of the companies term of notice for top level mangers extends up to 60 days depending upon the requirement. Usually, term of notice for other employees range from 15 to 45 days. In special cases, like health issues, almost all the companies wave off the notice period.

Duties during the term of notice (it is good to know that the term in Danish is opsigelsesvarsel)    You are responsible for your duties till the last minute you work in the organization. Therefore, never take your job lightly as you have decided to leave. Most of the companies call up the previous organization to track the performance of an employee before recruiting them. Thus a black mark on you can affect your future badly. Do your work well and co-operate with the management to smoothly hand over your responsibilities to the person who is going to take the chair after you leave.  You can read additional information about maternity leave rules if you follow the link.
